Subject: Tobacco Products In Vending Machines On NASA Facilities (REVALIDATED 10/27/11)

1. Policy

a. NASA prohibits the sale of tobacco products in vending machines located in or around any Government-owned or -leased space under NASA's custody and control. NASA also prohibits the distribution of free samples of tobacco products in or around any Government-owned or leased space under NASA's custody and control.

b. No areas shall be designated allowing the sale of tobacco products in vending machines even if such areas also prohibit the presence of individuals under 18 years of age.

2. Applicability

a. This NPD is applicable to NASA Headquarters and all NASA Centers, including Component Facilities and Technical and Service Support Centers,

b. For purposes of this NPD, the term "tobacco product" means cigarettes, cigars, little cigars, pipe tobacco, smokeless tobacco, snuff, and chewing tobacco.

c. NASA Exchange activities are covered by NPD 9050.6, NASA Exchange and Morale Support Activities.

3. Authority

a. The National Aeronautics and Space Act, as amended, 51 U.S.C. ยง 20113(a).

b. 41 Code of Federal Regulations (CFR) Part 101-20, "Management of Buildings and Grounds," Sections 101-20.109, 101-20.204, and 101-20.309.

c. NPR 1000.3, The NASA Organization.

4. Applicable Documents and Forms

5. Responsibility

a. The Assistant Administrator for Office of Strategic Infrastructure is responsible for issuing and overall management of this policy and shall ensure its implementation in accordance with the above-cited authorities.

b. The Executive Director, Office of Headquarters Operations, shall enforce this policy within Headquarters facilities.

c. Center Directors shall be accountable for enforcing this policy within their respective Centers and Component Facilities.

6. Delegation of Authority

The Assistant Administrator for Mission Support Directorate shall delegate the authority to implement the provisions of Section 636 of Public Law 104-52 related to prohibiting sales of tobacco products to minors on NASA installations.
