Chapter 3. The Reasonable Accommodation Reconsideration and Appeal Process

3.1 Requesting a Reasonable Accommodation Reconsideration

a. Within ten calendar days of a supervisor's denial of a request for reasonable accommodation, individuals may request reconsideration by contacting the DPM.

b. Employees who request reconsideration have the opportunity to provide additional information (e.g., new or different medical documentation, circumstantial changes, or other details) to help inform the reconsideration decision

c. Any new information the employee provides will be critical in helping the first-level supervisor make a fair reconsideration decision.

3.2 Informing Supervisor of Reconsideration Request

If appropriate, the DPM will inform the first-level supervisor that he/she needs to reconsider all the facts presented in the reconsideration request, including any new or additional information provided by the employee.

3.3 Making a Reconsideration Determination

During the reconsideration, the first-level supervisor shall consult with the DPM and Reasonable Accommodation Team (as needed), to make a determination on whether the employee is entitled to a reasonable accommodation.

3.4 Approving or Denying a Reconsideration

a. Once the reconsideration decision is made the supervisor will notify the employee of the decision in writing within ten calendar days of receiving the request, absent extenuating circumstances.

b. If the reconsideration is denied by the first-level supervisor, employees may contact the DPM to appeal the decision to their second-level supervisor within ten calendar days of receipt of denial.

3.5 Requesting an Appeal

a. Employees who request an appeal have the opportunity to provide additional information to help inform the appeal decision.

b. If appropriate, the DPM will inform the second-level supervisor that he/she needs to reconsider all the facts presented in the reconsideration request, including any new or additional information provided by the employee.

3.6 Making an Appeal Determination

a. On appeal, the second-level supervisor will review the first-level supervisor's decision and consider any new information.

b. The second-level supervisor shall consult with the DPM and Reasonable Accommodation Team (as needed), to make a determination on whether the employee is entitled to a reasonable accommodation.

3.7 Approving or Denying an Appeal

a. Once the appeal decision is made the second-level supervisor will notify the employee of the decision in writing within ten calendar days of receiving the request, absent extenuating circumstances.

b. If the second level supervisor denies the reasonable accommodation appeal, the employee has the right to contact an EEO Counselor within 45 days of receipt of written notice of a decision, in accordance with 29 CFR ยง 1614.105 (a)(1). Additionally, at any stage of the process employees can contact a EEO Counselor for questions, clarifications, or to initiate the informal complaint process
