PREFACE

P.1 PURPOSE

This NASA Headquarters Procedural Requirement (HQPR) applies to NASA Headquarters (HQ) Alternative Dispute Resolution (ADR) program activities in the Equal Employment Opportunity (EEO) context. This HQPR establishes procedures and operating principles for HQ Center-wide EEO ADR activities. These procedures are not intended to establish any rights to administrative or judicial review, or to establish a remedy for any NASA HQ employee or other person separate from existing rights under Federal laws and Equal Employment Opportunity Commission regulations. These procedures are intended to ensure EEOC regulatory requirements are met and consistent with the NASA Agency EEO ADR policy.

P.2 APPLICABILITY

This HQPR is applicable to NASA HQ Center including HQ serviced Facilities.

P.3 AUTHORITY

a. 5 U.S.C. õ 571 et seq., Administrative Dispute Resolution Act of (ADRA) 1996, as amended,

b. 29 C.F.R. Pt. 1614, Federal Sector Equal Employment Opportunity.

P.4 APPLICABLE DOCUMENTS

a. 29 U.S.C. õ 621 et seq., Age Discrimination in Employment Act of 1967, as amended.

b. 29 U.S.C. õ 621, Older Worker's Benefit Protection Act of 1990.

c. NPD 3713.8A, Provision of Reasonable Accommodation for Individuals with Disabilities.

d. NPR 3713.1A, Reasonable Accommodations Procedures.

P.5 MEASUREMENT/VERIFICATION

a. NASA HQ shall periodically evaluate the operations and success of the HQ EEO ADR program, and cooperate with periodic data-gathering and other evaluation activities including submitting ADR activity information for annual reporting to the EEOC.

b. The HQ ADR Manager shall distribute the "Evaluation Form" (see Appendix D, Form D.6) and the "Mediator's Evaluation Form" (see Appendix D, D.7) and collect these forms from each user of the mediation process who voluntarily chooses to complete these forms. If a mediation participant refuses to complete the evaluation, the Center should document the decision and reasons given, if any.

c. The HQ ADR Manager shall update the NASA Agency-wide complaints tracking system at the conclusion of each mediation. ODEO shall use this data to monitor trends and determine the extent to which EEO ADR assists in resolving disputes.
