1. POLICY

a. It is NASA's policy to:

(1) Publish its notices and regulations in the Federal Register to provide the public information on the Agency's activities, and where applicable, an opportunity to comment as prescribed by the Administrative Committee of the Federal Register, 1 Code of Federal Regulations (CFR) Parts (pts.) 1-12, 15-22, and 51, and in accordance with NASA Procedural Requirements (NPR) 1400.x, Regulatory Management Procedural Requirements.

(2) Report its planned regulatory activities under development to the Office of Management and Budget's (OMB) semiannual Unified Agenda of Federal Regulatory and Deregulatory Actions and summarize its regulatory priorities in OMB's annual Regulatory Plan.

(3) Provide the public and the Executive Office of the President timely advance notice of regulatory activities through the Agenda and Plan. Propose regulations only upon a reasoned determination that its benefits justify its cost and are tailored to impose the least burden on society.

(4) Submit copies of its major rules that have an economic effect to each house of Congress and the Comptroller General before they take effect.

(5) Conduct regulatory analysis on its regulations under development to identify and resolve tribal, federalism, and small business impacts, and to determine information collection requirements, assess costs and benefits of available regulatory alternatives and select regulatory approaches that maximize net benefits.

(6) Respond to actions described in executive orders issued by the President, requests to review regulations from other agencies, and petitions from the public requesting amendment or withdrawal of NASA codified regulations or to inform the Agency of misapplication in a timely manner.

2. APPLICABILITY

a. This directive is applicable to NASA Headquarters and NASA Centers, including Component Facilities and Technical and Service Support Centers.

b. In this NPD, all mandatory actions (i.e., requirements) are denoted by statements containing the term "shall." The terms: "may" or "can" denote discretionary privilege or permission, "should" denotes a good practice, and is recommended, but not required, "will" denotes expected outcome, and "are/is" denotes descriptive material.

c. In this directive, all document citations are assumed to be the latest version unless otherwise noted.

3. AUTHORITY

a. The National Aeronautics and Space Act, as amended, 51 United States Code § 20113(a).

b. Regulatory Planning and Review, Executive Order (E. O.) 12866

c. Improving Regulation and Regulatory Review, E. O. 13563.

d. Modernizing Regulatory Review, E. O. 14094.

e. Administrative Committee of the Federal Register, 1 CFR pts. 1-12, 15-22, and 51.

4. APPLICABLE DOCUMENTS AND FORMS

NPR 1400.x, Regulatory Management Procedural Requirements.

5. RESPONSIBILITY

a. The Administrator, or the designated senior official, is the approval authority for NASA regulations codified in National Aeronautics and Space Administration, 14 CFR pts. 1200-1299.

b. The Chief of Staff has overall responsibility for NASA's regulatory activities and serves as the Agency's Regulatory Policy Officer.

c. The Assistant Administrator for Procurement, or designee, is the approval authority for NASA regulations codified in Nonprocurement Debarment and Suspension, 2 CFR Part (pt.) 1880, Requirements for Drug-Free-Workplace (Financial Assistance), 2 CFR pt. 1882, and Federal Acquisition Regulations System, 48 CFR pts. 1801-1872 (NASA FAR Supplement, also referred to as the NFS).

d. Officials-in-Charge of Headquarters Offices, or designees, are responsible for ensuring that all notices and regulations under their authority comply with the requirements described in NPR 1400.x.

e. NASA Center Directors, or designees, are responsible for ensuring that all proposed notices comply with the requirements in NPR 1400.D57.

6. DELEGATION OF AUTHORITY

6.1 The NASA Administrator, or the designated senior official within the Office of the Administrator:

a. Designates a Federalism Officer, as required by Federalism, E.O. 13132.

b. Designates a Tribal Regulatory Review Officer, as required by Consultation and Coordination With Indian Tribal Governments, E.O. 13175.

c. Designates a Regulatory Policy Officer, as required by Regulatory Planning and Review, E.O. 12866.

d. Designates a Federal Register Liaison Officer, as required by Agency Representatives, 1 CFR § 16.1.

7. MEASUREMENTS

None.
