Chapter 7. Hours of Work During Phased Retirement

7.1 Required Part Time Work Schedules

During phased retirement, an employee's part time work schedule will be set in accordance with Working Percentage and Officially Established Hours for Phased Employment, 5 CFR ยง 831.1712, which is currently 40 hours per pay period, and Attendance and Leave, NPR 3600.1C.

7.2 Deviation of Part Time Work Schedule

7.2.1 In rare situations, an authorized official may order or approve a phased retiree to work in excess of their established part time schedule when all of the following conditions are met:

a. The work is necessary to respond to an emergency posing a significant, immediate, and direct threat to life or property.

b. There are no other qualified employees available to perform the required work.

c. The phased retiree is relieved from performing excess work as soon as reasonably possible.

d. When an emergency situation can be anticipated in advance, management made advance plans to minimize any necessary excess work by the phased retiree.

7.3 Approval of Work Schedule for More than Established Part Time Schedule

7.3.1 When approving hours to work more than the limit of hours currently allowed by regulation in a pay period, approving officials or their designees are responsible for:

a. Documenting the approval for the phased retiree for each applicable pay period.

b. Documenting the number of additional hours the employee will work in the pay period, and a justification that covers all the conditions and factors stated in paragraph 7.2 above.

c. Retaining this documentation for six years and forwarding a copy to the Center HR office.

7.3.2 An employee in phased retirement status may work under an alternative work schedule, to include the option to earn and use credit hours, in accordance with Center policy or any applicable Labor agreement. Phased retirees may not carry over more than 10 credit hours into the next pay period.

7.3.3 An employee in phased retirement may earn and use compensatory time off for travel and for religious purposes under existing policy and procedures.

7.3.4 Credit hours and compensatory time off earned for travel and religious purposes may be in excess of the 40 hour per pay period schedule; the provisions of paragraphs 7.2 and 7.3 do not apply.
